In his op-ed for AssCompact Austria, Dr. Christian Wolf reports on a case of abuse of rights in the use of a liability waiver guarantee due to “premature self-improvement”.
In a recent decision, the HG Wien came to the conclusion that a liability waiver guarantee issued exclusively for the collateralisation of warranty claims cannot be used to cover costs incurred due to an already completed rectification of defects by way of substitute performance.
