Jan Sramek Verlag: Festschrift Peter Bydlinski
On the occasion of his 65th birthday, a Festschrift was dedicated and presented to Prof. Dr. Peter Bydlinski. Dr. Georg Jeremias, RAA at ScherbaumSeebacher, contributed the article “The ‘Counter Right’ in Tort Law” to the anthology. The article deals primarily with the practically relevant question of whether it makes a difference in terms of the statute of limitations whether a claim for damages is actively sued for or merely asserted by the defendant as a defense in a lawsuit. According to recent tendencies in the literature, the mere assertion of a defense is not subject to the statute of limitations.
