The amount of digital assets is growing rapidly, whether they are cryptocurrencies such as bitcoins or various other content such as online user accounts. There are often questions about what to do with these digital assets after death and how to ensure that heirs have access to them. In his guest article in the Standard, our partner and expert in inheritance law, Dr Gerold Oberhumer, addresses this complex issue and explains the practice and classification under inheritance law. In particular, he discusses the practical implementation and common problems of legal succession and emphasises once again the importance of recording digital assets during one’s lifetime in order to regulate access by heirs.
